Terms of Service

1. Agreement to Terms

By accessing or using ClearRecord (operated by ClearRecord Driving LLC, a Wyoming limited liability company), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all visitors, users, and others who access or use the platform.

2. Description of Service

ClearRecord provides online driver improvement and defensive driving courses designed to satisfy state-mandated requirements including ticket dismissal, point reduction, license reinstatement, and insurance discount eligibility. Course availability, hours, and accepted uses vary by state. You are responsible for confirming with your court, the applicable state DMV, or your insurance provider that our course will satisfy your specific requirement before enrolling.

3. Eligibility

You must be at least 18 years of age to create an account and enroll in a course. By creating an account, you represent that the information you provide is accurate and that you are eligible to take the course for the reason you select at enrollment. ClearRecord reserves the right to terminate accounts that contain false or misleading information.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your login credentials or allow any other person to complete the course on your behalf. Doing so may constitute fraud, which can result in immediate account termination, certificate invalidation, and referral to the applicable state authority.

5. Payment

Course fees are due at enrollment and are processed securely through Stripe. All prices are displayed in US dollars and are inclusive of any applicable state fees unless otherwise noted. By providing payment information, you authorize ClearRecord to charge the total amount shown at checkout. Receipts are issued electronically upon successful payment.

6. Course Completion and Certificates

A certificate of completion is issued only upon successful completion of all required course content, time requirements, and any applicable final examination, as required by the state in which you are enrolled. Certificates are issued in the name of the registered account holder only. ClearRecord is not responsible for certificates that are rejected by courts, DMV offices, or insurance providers due to the student's individual eligibility, late submission, or failure to obtain prior court or agency approval where required.

7. DMV and Court Reporting

By completing a course, you authorize ClearRecord to electronically submit your course completion information to the applicable state DMV or designated reporting system as required by state law. For states where the driver is responsible for submitting the certificate directly to the court or DMV, ClearRecord is not liable for missed deadlines or rejected submissions.

8. No Guarantee of Acceptance

ClearRecord courses are designed to meet applicable state requirements; however, we cannot guarantee that a specific court, judge, insurance provider, or DMV office will accept your certificate in every circumstance. You are strongly encouraged to verify eligibility with the relevant authority before enrolling.

9. Intellectual Property

All course content, materials, software, and platform features are the property of ClearRecord Driving LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any course content without our express written permission.

10. Prohibited Conduct

You agree not to: (a) allow any other person to complete the course using your account; (b) use automated tools, bots, or scripts to advance through course content; (c) attempt to circumvent time requirements or identity verification; (d) reverse engineer or tamper with any platform technology; or (e) use the platform in any manner that violates applicable law.

11. Limitation of Liability

To the fullest extent permitted by law, ClearRecord Driving LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of driving privileges, insurance rate changes, or court sanctions. Our total liability to you for any claim arising under these terms shall not exceed the amount you paid for the course in question.

12. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. ClearRecord makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of any course content or the suitability of the course for any particular purpose.

13. Governing Law

These Terms of Service are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Sheridan County, Wyoming.

14. Changes to These Terms

We reserve the right to update these terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
